Terms of Service

1. Agreement

These terms govern your use of bluecollarq.net and, unless superseded by a signed written proposal or contract, the landscaping services provided by Blue Collar Q LLC, a Florida limited liability company at 4040 NW 36th Pl, Cape Coral, FL 33993 (“Blue Collar Q,” “we,” “us”). By using this site or engaging our services, you accept these terms. If a signed proposal for your project conflicts with these terms, the signed proposal controls.

2. Estimates & Website Pricing

Prices shown on this website — including published rates, starting prices, price ranges, and outputs of interactive estimator tools — are good-faith guidance, not binding offers. Every property is different; your binding price is the written quote we prepare after assessing your specific project. Estimates are free and carry no obligation. Written quotes are valid for 30 days unless stated otherwise. 3D design renderings are visual approximations of the planned work, not exact representations; plant sizes, colors, and material dye lots vary.

3. Scheduling, Access & Weather

You agree to provide reasonable access to the work area (gates unlocked, pets secured, vehicles moved) on scheduled service days. Southwest Florida weather is what it is — heavy rain, storms, and hurricane events may shift schedules, and we will communicate revised dates as quickly as we can. Recurring maintenance visits missed due to weather are made up or credited per your service plan.

4. Payment

Payment terms are stated on your quote or invoice. Deposits on install projects reserve materials and crew scheduling. Invoices are payable on receipt unless the quote states otherwise; unpaid balances more than 30 days past due may accrue interest at the highest rate allowed by Florida law and may result in suspension of service. Florida's Construction Lien Law (Chapter 713, Florida Statutes) may apply to improvement work: those who work on your property or provide materials and are not paid have a right to enforce their claim for payment against your property.

5. Warranties

Warranty coverage is stated on your written quote. As a general rule:

• Plants: qualifying landscape install projects include a 5-year plant warranty — plants that fail under normal conditions and with the agreed watering/irrigation in place are replaced. Damage from storms, freezes, pests introduced after install, neglect, or irrigation failures outside our control is excluded.
• Hardscape & irrigation workmanship: 1-year workmanship warranty on installation defects. Paver material defects are covered by the manufacturer's own warranty.
• Maintenance:if a maintenance visit misses the mark, tell us within 48 hours and we'll re-service it free.

EXCEPT AS EXPRESSLY STATED HERE OR IN YOUR QUOTE, SERVICES ARE PROVIDED WITHOUT OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

6. Property Conditions

You are responsible for identifying private underground installations we cannot see — unmarked irrigation lines, low-voltage wiring, septic components, and similar. We call in public utility locates (811) where digging requires it, but we are not liable for damage to unmarked private lines. Permit fees, HOA approvals, and any survey requirements are identified in your quote.

7. Limitation of Liability

To the maximum extent permitted by law, Blue Collar Q's total liability arising out of any service or use of this website is limited to the amount you paid for the specific service giving rise to the claim, and we are not liable for indirect, incidental, or consequential damages. Nothing in these terms limits liability that cannot be limited under Florida law. We carry general liability insurance and workers' compensation; certificates of insurance are available on request.

8. Website Use

• Site content — text, photos of our work, renders, and tools — belongs to Blue Collar Q LLC and may not be scraped, republished, or used commercially without permission.
• Don't misuse the site: no attempting to breach security, submitting false lead information, or interfering with forms and estimators.
• The website and its estimates are provided “as is” — see Section 2 on pricing guidance.
• Communications through our forms are governed by our Privacy Policy, including SMS consent and opt-out terms.

9. Governing Law & Disputes

These terms are governed by Florida law. Venue for any dispute is Lee County, Florida. Before filing anything, talk to us — most issues are resolved with a phone call to (239) 799-5594.

10. Changes

We may update these terms from time to time; the effective date above reflects the latest revision. Continued use of the site or services after changes are posted constitutes acceptance.
